Two Kenyan Police Officers Jailed 35 Years for Killing Man Over Face Mask Violation

Two former police officers in Kenya have been sentenced to 35 years in prison for the brutal murder of Dennis Lusava, a 31-year-old man accused of violating COVID-19 mask regulations in 2020. The Eldoret High Court delivered the verdict on Monday, bringing to a close a five-year trial that shocked the nation.

What Happened to Dennis Lusava?

The court heard that on October 7, 2020, the two officers, Emmanuel Wafula (38) and Godfrey Sirengo (35), arrested Lusava at Mbururu police post in Likuyani Sub-county, Kakamega County, for allegedly failing to wear a face mask. Instead of following legal procedures, they handcuffed Lusava to a window inside the police cell and subjected him to severe torture until he died.

To cover up the crime, they placed his body in a gunny bag and dumped it in the River Nzoia, which borders Bungoma and Kakamega counties.

What Did the Court Say?

Justice Reuben Nyakundi, who presided over the trial, ruled that the prosecution had proven its case beyond a reasonable doubt. “The accused persons had what it takes to secure the life of the deceased,” the Judge said. “They had no reason to torture the suspect and end his life.”

The officers’ request for a non-custodial sentence was dismissed, with the court stressing the seriousness of the crime. Justice Nyakundi emphasized the betrayal of duty by the officers, who were legally tasked with protecting life and property.

What Evidence Was Presented in Court?

The prosecution, led by Sidi Kirengo, presented 21 witnesses, including Lusava’s parents, Safani Malongo and Agnes Ambale. Additionally, 27 exhibits were brought forward, supporting claims of murder and cover-up.

Despite the officers’ continued denial of the charges, the court found their defense unconvincing. The judgment sends a strong message on accountability within the police force, especially in matters involving abuse of power and violation of human rights.

This case marks a rare conviction of police officers in Kenya and brings some closure to a family that has waited five years for justice. Lusava, a father of two children aged between 9 and 14, is now remembered not just as a victim but as a symbol in the ongoing fight for justice and police accountability in Kenya.
